Terms and Conditions

SECTION 1 - GENERAL

1.1 These general terms and conditions apply to all offers, orders and agreements that are made between the customer and Faren.

1.2 In addition, the general conditions also apply to every use of the website www.faren.be.

1.3 By placing an order with Faren you agree to the terms and conditions. 

1.4 Faren reserves the right to change its general terms and conditions.

1.5 Belgian law applies to all agreements, orders and quotations

SECTION 2 - STATE OF THE PRODUCT

2.1 All delivered products are offered in used condition. As a result, each product has its own characteristics and user traces.

2.2 All delivered products have been fully rewired to meet current EU regulations.

2.3 During the restoration process we aim to keep our products in their original state. Do keep in mind you are purchasing products in used condition and no two products are exactly the same.

2.4 All delivered products are suitable for incandescent, saving and LED lamps.

2.5 All delivered products are thoroughly tested for sale and delivered in a technically well-functioning condition.

2.6 All images, photographs, drawings and product specifications are approximate and are indicative.

SECTION 3 - PLACING AN ORDER

3.1 As soon as a lamp is ordered, the restoration process will be started. Please keep in mind this process can take up to seven (7) working days.

3.2 We will keep you updated about the status of your order through email.

3.3 If we do happen to have the lamp you ordered fully restored in stock , we will let you know it is ready for pick-up in store or to be shipped to your chosen address.

SECTION 4 - PRICES

4.1 All prices on the website, quotations and e-mail are in Euros.

4.2 Our products are covered by the VAT margin scheme. This means that they are exempt from VAT. If your preference is for an invoice with VAT, then this is possible.

4.3 All prices on the website, quotations and e-mail are exclusive of VAT and shipping costs.

4.4 All prices on the website, quotations and e-mail are subject to printing and typing errors.

4.5 Prices mentioned do not automatically apply to repeat orders.

SECTION 5 - AGREEMENT

5.1 The purchase and sale agreement is concluded at the moment of acceptance by the buyer of the offer and the fulfillment of the corresponding conditions.

5.2 Changing an agreement is only possible if Faren has accepted this in writing.

5.3 The agreement is only applicable to the first delivery unless otherwise stated.

5.4 All quotations and offers from Faren are without obligation until the moment that a written agreement has been reached for the purchase of products.

SECTION 6 - PAYMENT

6.1 During the realization of the agreement, the payment options depend on the method of collection. In principle, this can be done by prepayment, by debit card or cash. Faren will explain this during the ordering process by email.

6.2 Once Faren has received the full payment from the customer, it will proceed to deliver the product in the manner as agreed.

6.3 Faren applies a payment term of 7 days unless otherwise agreed upon.

6.4 If the customer remains in default of the payment obligation, Faren will send a reminder by e-mail. Additional administrative costs of 10% of the total amount will be charged.

6.5 If the customer still remains in default of the payment obligation following a demand for payment, Faren is entitled to call in a third party in order to recover the payment obligation from the customer.

6.6 All goods sold and delivered to the buyer by Faren remain the property of Faren as long as the customer has not fully complied with the payment obligation of the agreement.

6.7 The customer is not entitled to pledge the goods subject to the retention of title.

SECTION 7 - DELIVERY

7.1 The delivery term will be agreed between Faren and the customer by e-mail or by means of a quotation per order.

7.2 The customer has the possibility to come and view the products without obligation.

7.3 The customer has the possibility to pick up his items in-store. When the customer has collected these items, Faren can not be held liable for damage, theft or loss of the products.

7.4 During the transport of the products by Faren, Faren will bear the risk in case of damage, theft or loss of the products. At the time of delivery of the products, this risk passes to the customer.

7.5 When shipping by parcel post, Faren can not be held liable for damage, theft or loss of the products. All consignments are carefully packed and insured. The customer receives a package code by e-mail with which the shipment can be followed online.

7.6 The shipping or transport costs are stated per email or by means of a quotation per order. These depend on the order size and the delivery address.

7.7 Delivery takes place while stocks last.

SECTION 8 - RETURNS

8.1 The customer has the right to return (part of) the delivered goods within a period of 7 days without giving any reason. This period starts when the ordered goods have been delivered. If the customer has not returned the goods to Faren after this period, the purchase is a fact.

8.2 The customer is obliged to notify Faren in writing or by e-mail of his wish to return (part of) the delivered goods. The written notification must occur within 7 days after delivery of the goods and prior to returning the goods.

8.3 The customer must be able to prove that the delivered goods have been returned in time by, for example, proof of postal delivery.

8.4 Returned goods must be received by Faren in the same condition in which they were offered for sale.

8.5 Faren will not accept returned goods if they have been used by the customer or have been damaged in any way.

8.6 Regarding the general terms and conditions stated by Faren, Faren ensures that the purchase price will be refunded to the customer within 30 days after receiving the returned goods.

8.7 Returning goods is entirely at the expense and risk of the customer.

SECTION 9 - WARRANTY

9.1 Faren guarantees that the delivered goods meet the specifications stated on the website.

9.2 The goods to be delivered by Faren meet the requirements and standards that can reasonably be set at the moment of delivery and,are intended for normal use within Belgium. The guarantee applies to the use of the products within Belgium. When used elsewhere in the world, the customer must verify whether the use of our products is suitable within their country.

9.3 The guarantee of the delivered goods is valid for a period of two months after delivery. After expiration of the warranty period, all costs for replacement, including administration, shipping and transport costs are at the expense of the customer.

9.4 The guarantee expires when the defect arises as a result of or ensues from improper use, storage or maintenance of the delivered goods. Also when the defect is caused by or due to weather conditions.

9.5 The invoice received from Faren is considered a valid guarantee certificate.

9.6 At the time of delivery, the customer is obliged to check all delivered products and verify whether the quality and quantity corresponds to what has been agreed upon.

9.7 Any defects in the delivered product must be reported to Faren in writing or by e-mail within thirty (30) days accompanied by a clear description of the defect. This written report or e-mail containing a clear description of the defect should preferably also include pictures of said defect.

9.8 If it is certain that there is a defect and this falls within the warranty period, then Faren will replace or repair the defective product upon receipt. If this is not possible, Faren will refund the purchase price within thirty (30) days.

SECTION 10 - LIABILITY

10.1 Faren is not liable for damage, of whatever nature, caused by incorrect or incomplete information provided by or on behalf of the other party.

10.2 Faren is never liable for indirect damage as consequential loss, lost profit, missed savings and damage due to business and other stagnation.

10.3 The liability of Faren is in all cases limited to the amount paid by the insurer.

10.4 The risk of loss, damage or loss of value of the products passes to the customer the moment he becomes the owner of the delivered product.

SECTION 11 - DATA AND PRIVACY

11.1 Faren handles the personal and business information provided with care. The data will be kept confidential and will not be made available to third parties, made public or resold.

11.2 Faren respects the privacy of the users of the website and ensures confidentiality of the personal data.

11.3 Faren uses a mailing list. Each mailing contains instructions for the recipient to log out and to be removed from this list.

11.4 The customer must ensure that information such as address, e-mail address or bank account number is correct, complete and up-to-date. The customer also guarantees that it is legally authorized to make use of the website in any way.

SECTION 12 - WEBSITE

12.1 The website of Faren may contain references to websites of third parties. Faren has no control over these websites and is therefore not responsible for the content of these websites.

12.2 No part of the website www.faren.be may be made available to third parties in any way or reproduced without the prior written permission of Faren.

12.3 No hyperlink to the website www.faren.be may be used for commercial purposes without the prior written permission of Faren.

12.4 All rights with regard to the website, including the rights to texts, images, design, company name and domain name are vested in Faren.
